Update on "Reporting Code Violation Poll" and a campaign message

The poll numbers have been running neck and neck for weeks. The results of the “unscientific” poll show that citizens want code violations reported either by the CEO or by ordinary citizens just as long as an avenue for reporting is available to them.

Let me do a little campaigning here: If I’m elected Town Supervisor I would seek approval from the Town Board and the CEO to divide Lindley into four-quadrants to better manage “junk violations” and to insure the process was fair to all Lindley citizens.

After the town was divided into “four sections”, I would send a letter to everyone living in “Section One” listing the criteria of what constitutes a “junk law violation” according to Town Law. The letter would also inform each citizen in the Section that if they are in violation of the Law they have a “set amount of time” to clean up their properties. The letter would also inform them that after the “set amount of time had past”, the CEO would be around and check the properties and issue tickets if necessary. The CEO would “work one section at a time” through the course of the year.

This policy gives the citizens in each Section a “heads up” about the impending visit from the CEO and the personal letter defines exactly what a junk property is according to Town Law, their responsibility to clean it up and accountability through the legal process if they don’t clean it up in a timely manner. It would also make the CEO’s job more manageable and effective.

This is the “gist” of my policy. One important note: Before I implemented this policy I would create a “committee” to define what a Junk Property is in the Town of Lindley, taking into consideration many of the comments made on this blog and following the guidelines of the Junk Law.

I’d like to hear from the readers the pros and cons of this policy.

What good would dividing up the town in four sections and starting with section one when the town has issued tickets and knows people with extreme junk and unkept properties now and they never are made to clean up their property and they are never made to answer the tickets written? Seems to me the people that are the most violators laugh at the tickets and do nothing. NOT ENFORCING THE TICKETS ALREADY WRITTEN MAKES THE OTHER PEOPLE IN TOWN THAT TRY TO KEEP UP APPEARANCES LOSE FAITH IN THE TOWN BOARD,C.E.O. and the justice system!Maybe making them clean up would encourage the other people in town to have faith in the town board and maybe try a little harder to keep their place in better shape.

Sally- Good idea having group to decide what is junk as long as it is made up of people from the dirt road hills as well as the manicured down town blacktops.I know what i consider as being survival material when struggling to get by day to day would be considered junk by someone down town.As well as the repair projects that may only consist of minor repairs yearly that come well after putting food on the table and paying taxes for another year.I hope you and your commitee take into consideration why some of the townspeople live up here on the hills and dirt roads as opposed to living down town :)

The concept of dividing the town into four sections could help the CEO be more effective considering his part time position.By only concentrating on "One Section" at a time, the CEO can be more thorough for some obvious reasons. It's like cleaning a room in a house. If you start with one corner at a time, eventually the whole room gets clean. The CEO has many duties that take his time. By only having to work a section of town just to manage the "junk situation" would make him more effective. Sometimes when we're faced with a "big project" we feel overwhelmed and the only efficient way to complete a big task is to break it down into smaller parts/tasks. That's all I'm suggesting.

Also, on the issue of "follow through" of enforcement, once the policy was in effect, citizens would understand that the town was quite willing to fine "extreme" violators who thumb their noses at Town Law. But, citizens would have plenty of time to clean their places long before the CEO ever shows up. That's the central reason why I believe sending a "letter" announcing the policy/time frame puts the responsibility directly on the shoulders of each citizen in the Town of Lindley. If the policy was in force for a period of time and citizens felt the Town was both fair and "meant business", citizens would get accustomed to the "quarterly junk checks" that would ocurr every year. The policy would also "stay on top of the junk issue before it got out of hand".

Marc: Your "who should be in the group that determines what is a junk property in Lindley" suggestions are duly noted. Like you've said before, "One man's junk is another man's treasure".
It would be up to the group to determine what is junk and what is treasure and what violates a citizens civil liberties and whose civil liberties do we most protect.

You can be assured that I will work for and support the rights of the industrious rather than support the rights of "extreme blighters". In my opinion the rights of those in town who maintain their properties supercedes the rights of those who don't. It makes no sense to me to "reward" extreme blighters by looking the other way to protect their civil liberties when in the "real world" those who respect their properties are "punished" with loss of value on their homes. It's like rewarding bad behavior and punishing good.

However, to insure a checks and balance system, I would want "neat freaks" to sit on the panel as well as "moderates" and "civil Libertarians" who oppose any govenment regulation. That way all points of view on the junk issue would be represented on the panel. And as you suggested Marc, people who live on the hills and dirt roads would be included as well as, the "down towners" who live on paved roads.

This may be a very good idea or the worst one I ever came up with. It all depends on whether the "art of compromise" still exists in the Democratic process.

Sally: Nice concept. It intensifies pressure on just one section of town, while the other sections get to see what is happening and at least get a head start on cleaning up their own back yard. However, enforcement is going to be the big key. Can you stand behind what has come down as the town requirement. Good thinking.

There's no sense having Junk Laws in the book if you're not going to enforce them. Like I said in another comment, years ago people were more inclined to keep their places neat and tidy because social standards were in play and there was an automatic "stigma" attached so the enforcement of the Junk Law was hardly ever needed. Standards have changed because our culture has changed. Now more than ever, enforcement is vital to the Town.

Trust me. I won't have any trouble encouraging the CEO to bring the full weight of the Law down on "extreme violators" of the Junk Law. I don't scare that easy, and I don't care what people think of me. I wouldn't serve as Town Supervisor to "be popular". Been there, done that and that's a fools game. The problem with junk has been a longstanding, unresolved issue in town. It's time to address the problem with a well thought out policy that is fair to citizens and has real teeth to it.

As has been said "Beauty is in the eye of the beholder" I draw your attention to the front page of section D of Sun.7/2/05 Corning Leader.Now to these people and the world of art, the decorations are beauty.Personally, some of it belongs in the trash. I notice some of the local lawns now support used farm machinery as decorations. If a farmwer has these on his property,is it decoration or junk. Who is to judge?

Wouldn't allowing just the CEO to report violations be an invasion of allowing free speech as written in the constitution? Just a thought as this is supposed to be the land of free and home of the brave. Seems the federal government is taking more of these freedoms away what with the Patriot Act and now the Eminent Domain vote. What will we lose next?

I am uncomfortable with citizens "turning each other in" for junk and code violations. That sets a precedent for "spying" on each other and allows citizens to use the "zoning law" against each other for malicious reasons. I would prefer that the town establish a policy whereby the CEO was the lead agent in determining who was in violation. There is nothing more offensive than reading the town board or planning board minutes and discovering your name was mentioned for code violations. That strikes squarely at the heart of our civil liberties. I am a firm believer in that every man has the right to face with his accuser. All I would ask for is a lot more discretion and a proper channel when it comes to "overseeing code violations".
